Health plan contracts, randomness and legal security
reflections on the (im)possibility of unilateral termination of collective health plan contracts due to losses

This paper is presented to review aspects of the legal axiom that support the models of health care contracts offered between companies and consumers. The approach is made through the analysis of the definitions of aleatory contracts and commutative agreements, as parameters that can guide certain limits to be respected, especially in the events of termination of such agreements (for convenience types), to verify whether the notion that legal certainty is not exclusive to business companies that offer such plans is maintained, but, equally, is also a right of the vulnerable party that adheres to it.
