O Involuntary treatment of mental illness: a question of public health and human rights

Starting from a scientific and legal framework of the concept of mental illness and of its contextualization within policies of public health adopted by Portugal and by the European Union, the article reflects on involuntary treatment stipulated by the Portuguese law of mental health and of its compliance with the Constitution of the Republic, the European convention on human rights and the case law of the European court of human rights about this subject. A critical reflection on this theme is undertaken, supported by the analysis of relevant doctrine and case law, in order to demonstrate a more humanized conceptual and legal evolution of the approach to mental health. The involuntary treatment must not be applied as a punishment, but as an expression of the right to health founded on the principle of the dignity of the human person and on the respect of the essential core of the right of freedom.
