Abstract

This study examines the legal regime of supplementary protection certificates approved by the Portuguese Industrial Property Code and the Regulation (EC) 469/2009, of 6 may 2009. A summary analyses of the interpretation of the article 3 (a) is made. The study also analyses the amending to the Regulation (EC) 469/2009 by the Regulation (EU) 2019/933 that approved a manufacturing waiver for export purposes and the stockpiling of generic drugs.
